Pursuing All Available Options to Get You Out of Jail

In the criminal justice system, if you are acquitted, that decision is final, and there is nothing the prosecutors can do about it. If you are convicted, however, you have several opportunities to get that conviction overturned, including the following:

  • Appeals: You have a right to go to a higher court and argue that the judge made a mistake during your trial or made the wrong decision in response to a pretrial or post-trial motion filed by your attorney.
  • Post-conviction relief: Often considered a type of appeal, post-conviction relief is actually a separate option where you are attacking the original conviction based on new evidence, ineffective assistance of counsel or other factors.
